ON Y VA Returns Policy

1. Application and Legality of Returns Policy
1.1. Should you wish to return any product purchased from ON Y VA then this Returns Policy shall apply and, in this case, please send your request to hello@onyvashop.com or go to our store location to process the return request in-store (address below).

1.2. The law of South Africa applies to sales of product by ON Y VA to you. The Consumer Protection Act, 2008, applies in respect of the return of products which, inter alia, do not comply with the implied warranty of quality. The Electronic Communications and Transactions Act, 2002, applies in respect of the return of products purchased on-line, but apart from that South African law does not impose an obligation on a supplier to accept return of non-defective products. Nevertheless, as part of our added value for our customers, ON Y VA accepts return of non-defective goods in accordance with the terms of this Returns Policy.

2. Requirements
For all return requests, we require:
2.1. The invoice for the product or proof of purchase that meets our need to identify the sale in our records;
2.2. The product returned in the condition it was purchased in (new and unworn), with all/any labels still attached and in its original packaging; and
2.3. The reason for the return in writing.

3. If item 2.2 of this Returns Policy is not complied with, reasonable charges may be imposed on you for restoration or restocking purposes per section 20 of the Consumer Protection Act 2008.

4. Notice of Receipt and Decision

Once the returned product is received and inspected by ON Y VA, we will send you an email to notify you that we have received it. We will also notify you of the approval or rejection of your return request based on this Returns Policy. If the product is returned in-store then we will in most cases notify you immediately of the decision to approve or reject the return request, but we reserve the right to delay notifying you of the decision, for not longer than 3 business days, provided you agree to leave the product at our store for further inspection.

5. Returning Non-Defective Products and Online Purchases
5.1. Please retain the product in its original packaging, with labels attached, keep the product and its packaging clean and undamaged, and do not wear or use the product.

5.2. For in-store purchases:
5.2.1. provided you comply with item 5.1 you are entitled to return any non-defective product purchased from us if you are not satisfied with the fit of the product within 10 business days of the date on which the product was purchased; and
5.2.2. we will exchange such non-defective in-store purchased product for a product of equivalent value which we have in stock or provide you with a gift voucher to the value of the non-defective product returned by you.

5.3. For online purchases:
5.3.1. please comply with item 5.1 to facilitate the return of any product purchased online from us;
5.3.2. you are entitled to return online purchases within 7 days after the date the product is delivered to you; and
5.3.3. we will, at your option, provide a full refund of the price paid, exchange such product for a product of equivalent value which we have in stock or provide you with a gift voucher to the value of product returned by you.

5.4. Exchanges will be granted only for regular stock and not for sale, discounted or promotional stock.

5.5. For non-defective products and online purchase returns, you will be required to deliver the returned product in store or by courier at your own cost and at your risk. You will also be required to pay for any costs relating to the delivery of the exchanged product to you.

5.6. If couriering the product, please utilise a reputable courier company with a tracking facility.

6. Returning Defective Products

6.1. Please retain the product in its original packaging, with labels attached, keep the product and its packaging clean and undamaged, and do not wear or use the product.

6.2. Please send us an email requesting a return or visit the store to apply for the return.

6.3. The provisions of the Consumer Protection Act, 2008 apply to the return of defective products.

7. Return of Incorrect Products Delivered
7.1. If we accidentally deliver the wrong product to you or if the product is not as described on the website, please retain the products’ original packaging, with labels attached, and do not wear the product.

7.2. Please notify us and return the goods within 10 business days of delivery of the incorrect products, after which time no return will be considered.

7.3. Once we have inspected the product and validated your return, we will, at your choice:
7.3.1. exchange such product for product of equivalent value; or
7.3.2. refund to you the purchase price of the product,
including a refund of any reasonable courier cost, but less any charges contemplated in item 3 of this Returns Policy.

8.2. Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

9. General
9.1. Please familiarise yourself with the provisions of this Returns Policy as ON Y VA is under no obligation to provide you with a refund, repair or replacement for any return outside of the time periods and conditions mentioned in this Returns Policy.

9.2. The above is the sole policy in respect of returns applicable to ON Y VA products and is compliant with the Consumer Protection Act, 2008 and the Electronic Communications and Transactions Act, 2002 as at April 2019. A short summary of certain aspects of this Returns Policy is included on our invoices for convenience but this Returns Policy takes precedence.
